WiFi Service Terms & Personal Data Policy

1. WiFi Service Provider

This guest WiFi network service is operated by the respective venue merchant, business operator, or store location ("Merchant", "Venue Operator", "We") using technology infrastructure, Captive Portal frameworks, and access gateways powered by Pocketify.

2. Categories of Data Collected

When you connect to or authenticate on this WiFi network, the following categories of data may be collected:

1. Registration Form Data: Name, mobile telephone number, email address, date of birth, gender, or custom input fields completed on the Captive Portal.
2. External Account Identifiers: LINE User ID, Social Login tokens, or authorized third-party profile data.
3. Hardware & Network Identifiers: Device MAC Address, IP Address, Device Name, Browser User-Agent, Operating System, and device parameters.
4. WiFi Connection Telemetry: Access timestamps, connection duration, data volume transmitted/received, Signal Strength (RSSI), and Access Point identifier.
5. Venue & Branch Location Data: Specific store branch, zone, or venue physical location where connection was initiated.
6. Campaign Responses: Coupon redemptions, feedback surveys, promotional clicks, or activity participation logs.

3. Purposes of Collection & Use

Collected data is processed for legitimate operational and compliance purposes:

1. To authenticate user identity and grant guest WiFi internet connectivity.
2. To prevent unauthorized, fraudulent, or illegal network access.
3. To inspect, debug, and optimize WiFi network performance and bandwidth distribution.
4. To compile aggregated venue foot-traffic analytics and visitor usage reports for the Merchant.
5. To issue exclusive promotional privileges, coupons, or store announcements where authorized.
6. To fulfill mandatory computer traffic log retention requirements under statutory cybersecurity laws (including Thailand Computer Crime Act log compliance).
7. To safeguard network infrastructure, servers, and connected users against malicious attacks.

4. Marketing Communications & Opt-Out

Where explicit consent is provided, the Merchant may send marketing communications, promotional vouchers, or event updates via SMS, Email, LINE, or registered contact channels.

You reserve the right to opt out of marketing communications at any time via opt-out links in messages or by contacting the Merchant. Opting out of marketing does not affect essential service communications or legal compliance logs.

5. Role of Pocketify Platform

Pocketify operates as a software technology platform facilitating WiFi login portals, network authentication, visitor analytics, and subscriber storage for Merchants.

6. Data Disclosure

Personal data may be disclosed strictly under necessary operational conditions:

1. To Pocketify and authorized cloud subprocessors (e.g., SMS Gateways, Email Providers) for message delivery and platform management.
2. Pursuant to valid court orders, statutory law enforcement demands, or official regulatory investigations.
3. To investigate, prevent, or take action regarding illegal activities, cyberattacks, or network safety breaches.

7. Data Retention Schedule

Data is retained for the duration required to provide guest WiFi, fulfill computer log compliance regulations (minimum 90 days traffic log compliance under statutory computer laws), and execute legitimate marketing programs. Expired records are deleted or anonymized.

8. Technical Security Safeguards

Appropriate technical safeguards, including HTTPS/TLS portal encryption, access key security, and database isolation, are implemented. However, as public wireless networks carry inherent open-air transmission risks, users are advised to avoid transmitting sensitive credentials over unencrypted connections.

9. Acceptable Use Policy & Prohibitions

Users agree not to use the WiFi service for any unlawful or harmful activities, including:

1. Committing criminal offenses or violating intellectual property rights.
2. Attempting unauthorized access to remote systems, port scanning, or hacking.
3. Distributing malware, viruses, phishing links, or unsolicited bulk messaging (spam).
4. Interfering with network bandwidth, conducting Denial-of-Service (DoS) attacks, or disrupting service for others.

The Merchant and Pocketify reserve the right to suspend or block network access immediately for any violation.

10. Limitation of Liability

The WiFi service is provided on an "as is" and "as available" basis without warranties of uninterrupted availability, speed, or absolute security. Neither the Merchant nor Pocketify shall be liable for indirect damages or data loss resulting from network usage, except as mandated by law.

11. Data Subject Rights

End Users maintain legal rights under PDPA regulations to request access, correction, deletion, restriction, or consent withdrawal regarding their personal data by contacting the Venue Merchant or Pocketify support.
